Overview

Reports to: Special Credits Enforcement Manager

 

Functions Supervised: Special Credits Enforcement Litigation

 

Primary Functions: This position involves regular interaction with (1) attorneys and law firm staff engaged to represent the credit union on collections matters, (2) local, state, and federal agencies relevant to collections activities, and (3) the courts with jurisdiction over these collections matters.  The role is responsible for managing routine collections litigation matters and coordinating closely with collection teams to minimize losses for the credit union. This individual will play a crucial role in energizing the Special Credits Enforcement litigation team, ensuring high productivity, quality of work and attention to detail, while adhering to all relevant state and federal laws, regulations, and credit union policies and procedures.  

 

Duties and Responsibilities:

  1. Collaborate with outside counsel to resolve delinquent accounts through collateral recovery, judgments, and garnishments. Track and manage attorney and third-party expenses, including review of legal bills using Legal Tracker.
  2. Ensure timely processing of small claims filings and prompt completion of legal actions on assigned accounts.
  3. Represent the credit union at small claims court hearings when necessary.
  4. Handle payments, settlements, and/or the surrender of collateral with members and, as needed, attorneys involved in collections cases.
  5. Prepare affidavits, detailed correspondence, and other case-related documents.
  6. Work with Consumer Lending management on dealer buybacks and initial payment defaults.
  7. Refer collections matters to designated credit union-approved outside counsel.
  8. Escalate non-routine litigation matters to the credit union's Legal Department for handling and resolution. Work with the Legal Department as requested.
  9. Reply to emails and phone calls promptly and accurately.
  10. Make decisions on settlements or confessions of judgment on behalf of the credit union, within prescribed authority limits.
  11. Review, revise and/or sign declarations, as necessary.
  12. Provide monthly reporting for the Special Credits Enforcement Litigation department.
  13. Perform other assigned duties.

 

Qualifications

Education: A bachelor's degree in legal studies, business, finance, or a related field is expected. Advance degrees in law, business, or other related professional compliance or legal certifications are preferred.

 

Creditable Experience in Lieu of Education: At least two years of experience in an in-house legal department of a financial institution managing collection or bankruptcy litigation.

 

Experience/Skills: Must be self-driven with excellent verbal and written communication skills. Leadership skills are essential, with a proven ability to manage and motivate employees. Experience in legal processes involving repossessions, bankruptcy, collections, and recovery for varied types of consumer debt preferred. Sound judgment, strong negotiation abilities, management and critical thinking skills, as well as strong attention to detail are required.

Compensation

Senior Special Credits Litigation Officer (Category 08)

 

Salary Pay Range: $72,717 $119,983 annually. Starting base salary will be determined based on candidate experience, qualifications, education, and local or state wage requirements, if applicable and will fall within the range provided above.

 

In accordance with our Salary Administration policy, new hire base salaries generally fall within the minimum to midpoint of the listed range.
